Enforcement Notice Issued by Blaby District Council
10th July 2007 - Enforcement Notice Served
At the Blaby District Council Development Control Meeting (21st June 2007) the planning councillors considered item number 5 on the agenda. They voted overwhelmingly to issue an Enforcement Notice on the whole development.
The enforcement notice came into effect: 16th August 2007.

Accordingly the Entire Development is Unauthorised
This is an enlargement of why the enforcement notice has been issued on the new flats in Blaby at Orchard Mews.
The development as constructed has not been carried out in accordance with the approved plans. Accordingly the entire development is unauthorised as it does not have the benefit of the
planning permission granted 15th December 2003 or any of the subsequently approved amendments. The changes made to the building during its construction result in poor quality design elements
and excessive building height which detract from the appearance of the building are are intrusive in the street scene. As a consequence it is considered that the building is detrimental to the
character and appearance of the Blaby Central Area and therefore contrary to the provisions of Policy S9 of the Blaby District Local Plan.
POLICY S9
This is "Policy S9"
Planning permission will only be granted for development which would have a significant effect in the central area of Blaby if it meets all of the following criteria:
(i) it would be compatible with the scale, character and role of Blaby Central Area;
(ii) it would have good pedestrian links with the existing shopping areas and public car parks;
(iii) it would not be significantly detrimental to the amenities enjoyed by the occupiers or properties adjacent to Blaby Central Area;
Planning permission will not be granted for development, including residential development, which would undermine the vitality
and viability of Blaby Central Area.
